Monument Care Plan Service Agreement
Effective Date: August 6, 2026
This Monument Care Plan Service Agreement ("Agreement") is entered into between Kentucky Monument Care ("Company," "we," "our," or "us") and the customer ("Customer," "you," or "your"). By enrolling in a Monument Care Plan, approving a recurring service estimate or invoice, signing this Agreement electronically or in writing, or allowing recurring payments to begin, you acknowledge that you have read, understand, and agree to the terms below.
1. Purpose of Agreement
Kentucky Monument Care provides recurring headstone and monument cleaning and maintenance services designed to help preserve the appearance and condition of memorials over time. This Agreement governs all recurring Monument Care Plans offered by Kentucky Monument Care.
This Agreement supplements, and should be read together with, the Kentucky Monument Care General Terms & Conditions. If there is a conflict between this Agreement and the General Terms & Conditions, this Agreement controls only with respect to recurring Monument Care Plans.
2. Monument Care Plans
The Company may offer recurring service plans including, but not limited to:
- Monthly Care Plan
- Quarterly Care Plan
- Semi-Annual Care Plan
- Annual Care Plan
The frequency and pricing of each plan will be listed on your approved estimate, proposal, invoice, or service agreement.
Unless otherwise stated in writing, each scheduled visit includes a standard monument cleaning appropriate for the selected plan.
Certain restoration services, repairs, resetting, biological stain removal requiring multiple treatments, repairs to damaged monuments, or specialty services may require additional charges.
3. Scope of Services
Each scheduled visit may include, when appropriate:
- Inspection of the memorial
- Gentle cleaning using monument-safe methods
- Removal of dirt, dust, pollen, algae, mold, mildew, moss, lichens, and other biological growth when reasonably possible
- Cleaning of monument surfaces
- Light rinsing
- Before and after photographs (when practical)
- Service documentation
The Company reserves the right to determine the safest and most appropriate cleaning methods for each monument.
4. Services Not Included
Unless specifically agreed to in writing, Monument Care Plans do not include:
- Monument repairs
- Resetting monuments
- Crack repair
- Adhesive removal
- Epoxy work
- Structural stabilization
- Bronze refinishing
- Letter repainting
- Sandblasting
- Power washing
- Landscape maintenance
- Flower replacement
- Decorations
- Vase replacement
- Cemetery maintenance
- Cleaning of surrounding lots beyond normal overspray or rinsing
- Emergency services
These services may be quoted separately.
5. Scheduling
Service visits are scheduled according to your selected plan.
Kentucky Monument Care will determine the exact service dates.
Specific appointment times are not guaranteed.
Visits may be adjusted due to:
- Weather
- Cemetery restrictions
- Holidays
- Equipment issues
- Employee illness
- Safety concerns
- Natural disasters
- Other unforeseen events
Reasonable schedule adjustments do not constitute a breach of this Agreement.
6. Weather Delays
Monument cleaning cannot always be safely or effectively completed during:
- Freezing temperatures
- Lightning
- Heavy rain
- Snow
- Ice
- Flooding
- Hazardous weather
If a visit must be postponed, it will be completed as soon as reasonably practical.
7. Cemetery Access
Customer is responsible for ensuring that:
- The monument can legally be serviced.
- Cemetery rules permit cleaning.
- The Company is allowed access.
If access is temporarily unavailable, the visit may be rescheduled.
If access remains unavailable for an extended period, the Company may suspend or terminate service.
8. Customer Responsibilities
The Customer agrees to:
- Provide accurate cemetery information.
- Provide the correct grave location whenever possible.
- Notify the Company of any location changes.
- Notify the Company of any ownership disputes.
- Notify the Company if the monument becomes damaged.
- Notify the Company of changes to billing information.
- Maintain valid payment information.
Failure to provide accurate information may delay service.
9. Existing Monument Condition
Many monuments are decades or even centuries old.
Kentucky Monument Care does not guarantee that every stain, discoloration, biological growth, rust mark, mineral deposit, or environmental discoloration can be completely removed.
Some staining may be permanent.
Some monuments may contain hidden fractures, weakened materials, previous repairs, unstable foundations, or deteriorated stone.
Cleaning may reveal previously hidden defects.
The Company is not responsible for deterioration caused by:
- Age
- Weather
- Freeze/thaw cycles
- Previous repairs
- Poor installation
- Defective stone
- Historical damage
- Existing cracks
- Existing instability
10. Cleaning Methods
Kentucky Monument Care uses monument-safe cleaning techniques whenever practical.
Cleaning methods may include:
- Soft brushes
- Low-pressure water
- Non-acidic cleaners
- Biological cleaning agents
- Manufacturer-approved monument cleaning products
The Company reserves sole discretion regarding which methods are appropriate.
11. No Guarantee of Permanent Results
Biological growth is a natural process.
Kentucky Monument Care does not guarantee that:
- Algae will never return.
- Mold will never return.
- Moss will never return.
- Lichens will never return.
- Staining will never return.
Recurring maintenance reduces future buildup but cannot permanently prevent natural environmental conditions.
12. Pricing
Customer agrees to pay the pricing listed on the approved estimate, invoice, or recurring billing schedule.
Prices are exclusive of applicable taxes unless otherwise stated.
13. Automatic Payment Authorization
By enrolling in a Monument Care Plan, Customer authorizes Kentucky Monument Care to automatically charge the payment method provided for the recurring charges associated with the selected plan.
Charges will occur according to the selected billing frequency.
Customer is responsible for maintaining valid payment information.
If a payment method expires or becomes invalid, Customer agrees to promptly provide updated payment information.
14. Failed Payments
If a recurring payment is declined, Kentucky Monument Care may:
- Retry the payment.
- Contact the Customer.
- Suspend future service.
- Pause the care plan until payment is received.
- Terminate the Agreement for non-payment.
Service is not guaranteed while an account is delinquent.
15. Minimum Commitment and Cancellation
To help maintain consistent care of your memorial and to allow Kentucky Monument Care to provide recurring services at discounted care plan pricing, each Monument Care Plan requires a minimum initial service commitment.
The minimum commitments are as follows:
- Monthly Care Plan: Minimum commitment of three (3) consecutive monthly billing cycles.
- Quarterly Care Plan: Minimum commitment of two (2) consecutive quarterly billing cycles.
- Semi-Annual Care Plan: Minimum commitment of two (2) consecutive semi-annual billing cycles.
- Annual Care Plan: Minimum commitment of one (1) annual billing cycle.
After the applicable minimum commitment has been satisfied, the Monument Care Plan will continue on a recurring basis until canceled by either party.
Customers may cancel their Monument Care Plan at any time after the minimum commitment has been fulfilled by providing notice to Kentucky Monument Care. Cancellation will become effective at the end of the current paid billing period, and no further recurring charges will be assessed.
If a customer requests cancellation before the required minimum commitment has been completed, Kentucky Monument Care may continue billing until the minimum number of billing cycles has been satisfied or may, at its sole discretion, allow an early cancellation.
No refunds will be issued for services already performed or for billing cycles that have already begun.
16. Company Termination
Kentucky Monument Care reserves the right to terminate this Agreement if:
- Payment remains delinquent.
- Cemetery access becomes impossible.
- Unsafe conditions exist.
- The monument becomes unstable.
- Fraud is suspected.
- The Customer violates this Agreement.
- Continued service would create unreasonable risk.
17. Price Changes
Kentucky Monument Care may periodically adjust pricing.
Customers will receive reasonable advance notice before recurring pricing changes become effective.
Continued participation after the effective date constitutes acceptance of the updated pricing.
18. Photographs
Kentucky Monument Care may photograph the monument before, during, and after service for documentation, quality control, insurance, training, and customer communication.
With Customer's permission, photographs that do not reveal personal information may also be used for marketing, educational materials, social media, advertisements, or the Company's website.
Customers may opt out of marketing use by notifying the Company in writing. This does not affect the Company's right to retain photographs for internal documentation, insurance, quality assurance, or legal purposes.
19. Limitation of Liability
To the fullest extent permitted by Kentucky law:
Kentucky Monument Care shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from services performed under this Agreement.
The Company's maximum liability for any claim shall not exceed the amount paid by the Customer for the most recent service visit giving rise to the claim.
20. Indemnification
Customer agrees to indemnify and hold harmless Kentucky Monument Care, its owners, employees, contractors, and representatives from claims arising out of inaccurate information provided by the Customer, ownership disputes, unauthorized service requests, or conditions beyond the Company's control.
21. Force Majeure
Kentucky Monument Care shall not be liable for delays or failure to perform caused by events beyond its reasonable control, including severe weather, natural disasters, cemetery closures, government actions, labor shortages, equipment failures, transportation interruptions, pandemics, or other unforeseen events.
22. Governing Law
This Agreement shall be governed by the laws of the Commonwealth of Kentucky without regard to conflict of law principles.
Any legal action shall be brought in a court of competent jurisdiction located within the Commonwealth of Kentucky.
23. Severability
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
24. Entire Agreement
This Agreement, together with the Kentucky Monument Care General Terms & Conditions, the approved estimate or invoice, and any written amendments signed by both parties, constitutes the entire agreement between the parties concerning the Monument Care Plan.
25. Electronic Acceptance
Customer agrees that electronic signatures, electronic approvals, digital checkboxes, online acceptance, recurring payment authorization, and electronic records shall have the same legal force and effect as handwritten signatures to the fullest extent permitted by applicable law.
