Terms of Service

These Terms of Service (“Agreement”) govern all services provided by Kentucky Monument Care (“Kentucky Monument Care,” “KMC,” “we,” “our,” or “us”).
By approving an estimate, accepting an invoice, making a payment, scheduling service, electronically accepting these Terms, signing a proposal, or allowing Kentucky Monument Care to begin work, the customer (“Customer,” “you,” or “your”) acknowledges that they have read, understood, and agree to be legally bound by these Terms & Conditions.
1. Scope of Services
Kentucky Monument Care provides professional monument, memorial, and gravesite maintenance services, including but not limited to:
- Headstone cleaning
- Monument cleaning
- Grave marker cleaning
- Memorial restoration cleaning of a non-structural nature
- Biological growth treatment and removal
- Dirt and debris removal
- Memorial care visits
- Gravesite appearance services
- Flower placement, if purchased
- Flag placement, if purchased
- Seasonal memorial services
- Ongoing monument maintenance plans
- Other services specifically described in an approved estimate
Unless specifically listed on the Customer’s approved estimate, Kentucky Monument Care’s services do not include:
- Monument repair
- Monument resetting
- Monument re-leveling
- Epoxy repairs
- Structural stabilization
- Stone carving
- Letter repainting
- Engraving
- Landscaping
- Tree, shrub, or root removal
- Concrete work
- Cemetery-wide maintenance
- Permanent structural restoration
- Monument replacement
- Repair of foundations, bases, or surrounding concrete
- Removal or replacement of the monument
Kentucky Monument Care is responsible only for the services specifically listed in the Customer’s approved estimate, proposal, or invoice. Any work not expressly included is outside the scope of the agreement unless separately approved in writing.
2. Website Pricing, Starting Prices, and Individual Estimates
All prices displayed on the Kentucky Monument Care website, social media pages, advertisements, printed materials, promotional materials, directories, online listings, or other marketing materials are provided for general informational purposes only.
Unless expressly stated otherwise in writing, all published prices are starting prices and are not guaranteed final prices.
Website pricing and advertised pricing do not constitute:
- A binding offer
- A guaranteed price
- A final estimate
- A promise that a particular monument qualifies for the lowest advertised price
- An agreement to perform services for the amount displayed online
Every monument, memorial, grave marker, and gravesite is unique. Kentucky Monument Care will individually evaluate each requested project and provide the Customer with a customized estimate before work begins.
Final pricing may be based on factors including, but not limited to:
- Monument size
- Monument height
- Monument width
- Monument shape
- Monument design
- Monument material
- The number of monuments or markers being serviced
- The condition of the monument
- The age of the monument
- The severity of biological growth
- The amount of dirt, staining, or discoloration
- The presence of moss, lichen, algae, mildew, mold, or other biological material
- The amount of labor required
- The anticipated number of treatments or visits required
- The type and amount of cleaning solution required
- Accessibility of the gravesite
- Distance from an accessible roadway or parking area
- Cemetery access requirements
- Travel distance
- Special scheduling requests
- Requested additional services
- Conditions that may affect the safe completion of the work
- Any other circumstances affecting the time, labor, materials, travel, complexity, or risk involved
The final price for a project will be the amount stated in the estimate, proposal, or invoice approved by the Customer.
No work will begin until the Customer has approved the applicable estimate or otherwise authorized the quoted services and pricing.
Kentucky Monument Care reserves the right to revise an estimate if:
- The Customer provided incomplete or inaccurate information
- The incorrect monument was photographed, described, or identified
- The monument’s actual size or condition differs materially from the information originally provided
- Previously undisclosed or hidden conditions are discovered
- The requested scope of work changes
- Additional services are requested
- Cemetery restrictions or access conditions increase the work required
- Conditions at the gravesite materially affect the cost or safe completion of the work
If a material price adjustment becomes necessary before work begins, Kentucky Monument Care will notify the Customer. No additional work associated with the revised price will be performed without the Customer’s approval.
3. Authorization to Perform Work
By accepting an estimate, making payment, scheduling service, or permitting Kentucky Monument Care to begin work, the Customer represents and certifies that:
- The Customer owns or controls the monument or memorial;
- The Customer is an immediate family member or lawful representative with authority to authorize the work;
- The Customer has obtained permission from the lawful owner, responsible family representative, cemetery, organization, or other person whose approval may be required; or
- The Customer otherwise possesses the legal authority necessary to request and approve the services.
Kentucky Monument Care is entitled to rely upon the Customer’s representation that the Customer has authority to authorize the requested work.
Kentucky Monument Care is not responsible for independently investigating:
- Family relationships
- Monument ownership
- Burial rights
- Cemetery lot ownership
- Estate authority
- Authorization disputes
- Conflicting instructions from family members
- The existence of other persons who may claim authority over the monument
Kentucky Monument Care is not responsible for disputes among family members, cemetery lot owners, estate representatives, burial-right holders, or other interested parties regarding authorization.
If ownership or authorization is later disputed, the Customer agrees to defend, indemnify, and hold Kentucky Monument Care harmless from resulting claims, demands, damages, expenses, losses, or legal proceedings to the fullest extent permitted by law.
Kentucky Monument Care reserves the right to suspend or discontinue work if authorization is questioned or disputed.
4. Correct Monument Identification
The Customer is responsible for providing accurate information sufficient to identify the correct monument, marker, or gravesite.
This information may include:
- Cemetery name and address
- Section, Lot, Row, Grave number
- GPS coordinates
- Name appearing on the monument
- Date of birth and Date of death
- Photograph of the monument
- Nearby landmarks
- Names on surrounding monuments
- Any other identifying information requested by Kentucky Monument Care
Kentucky Monument Care will make reasonable efforts to locate and verify the monument before beginning work.
Kentucky Monument Care is not responsible for delays, additional travel, or inability to complete the service when the Customer provides inaccurate, incomplete, outdated, or misleading location information.
Kentucky Monument Care will not knowingly perform work on a monument that cannot be reasonably identified.
If Kentucky Monument Care determines that additional information is required, service may be postponed until the Customer provides sufficient information.
5. Cemetery Permission and Regulations
Some cemeteries maintain policies, regulations, operating hours, access restrictions, insurance requirements, contractor rules, or approval procedures governing outside service providers.
The Customer is responsible for determining whether permission is required from:
- The cemetery, cemetery association, or cemetery board
- A church or municipal authority
- A private landowner or family cemetery representative
- A monument owner
- Any other person or organization controlling access to the property
When required, the Customer is responsible for obtaining permission before service is performed unless Kentucky Monument Care expressly agrees in writing to handle that process.
Kentucky Monument Care agrees to make reasonable efforts to comply with known cemetery regulations and instructions.
Kentucky Monument Care reserves the right to cancel, postpone, suspend, or discontinue service if:
- Cemetery personnel deny access or request that work stop
- Required permission has not been obtained
- Cemetery regulations prohibit the requested service
- The cemetery is closed or access is unsafe
- Conditions on the property prevent lawful or safe completion of the work
Kentucky Monument Care will not be responsible for delays caused by cemetery rules, cemetery personnel, cemetery closures, access restrictions, burial services, funerals, groundskeeping operations, or other circumstances outside our control.
If travel has already occurred before access is denied because the Customer failed to obtain required permission, Kentucky Monument Care reserves the right to retain or charge a reasonable trip fee or reimbursement for travel-related expenses.
6. Industry-Accepted Cleaning Methods
Kentucky Monument Care follows industry-accepted monument conservation and cleaning practices whenever practical and appropriate for the monument being serviced.
Kentucky Monument Care uses cleaning methods intended to safely preserve the natural integrity and appearance of memorial stone.
Kentucky Monument Care does not intentionally use methods known to unnecessarily damage monuments, including:
- High-pressure power washing
- Sandblasting
- Acid washing
- Wire brushes
- Harsh abrasive cleaning
- Unsafe chemical treatments
- Methods that intentionally remove substantial portions of the stone surface
Cleaning methods, products, tools, treatment times, and procedures may vary depending on stone type, age, monument condition, surface integrity, biological growth, staining, prior repairs, existing damage, weather conditions, temperature, cemetery regulations, manufacturer instructions, professional judgment, and safety considerations.
Kentucky Monument Care retains discretion to select the products, tools, techniques, procedures, and amount of treatment reasonably believed to be appropriate for the monument.
The Customer understands that conservative cleaning methods may produce gradual rather than immediate results.
7. Natural Characteristics of Stone
Natural stone changes over time.
Cleaning does not make a monument “brand new,” and Kentucky Monument Care does not represent that cleaning will restore every monument to its original manufactured condition.
Our goal is to safely improve the monument’s appearance while preserving its natural character, structural integrity, and historic patina.
Natural or age-related characteristics may include:
- Weathering
- Pitting
- Surface erosion
- Mineral staining
- Rust staining
- Iron deposits
- Biological discoloration
- Surface fading
- Letter wear
- Loss of polish
- Color variation
- Uneven aging
- Natural veining
- Surface roughness
- Environmental staining
- Discoloration caused by nearby soil, trees, plants, sprinklers, metal, or landscaping
These conditions may remain visible after cleaning.
Some markings that appear to be dirt may instead be permanent characteristics of the stone, mineral deposits, weathering, oxidation, surface loss, or discoloration within the material.
Kentucky Monument Care does not guarantee the removal of natural stone characteristics or permanent age-related changes.
8. No Guaranteed Cosmetic Result
Because every monument is unique, Kentucky Monument Care cannot guarantee:
- Complete stain removal
- Uniform coloring
- A bright white appearance
- Full biological removal in a single visit
- Complete restoration of inscriptions
- Restoration to the monument’s original appearance
- Removal of mineral or rust stains
- Elimination of all discoloration
- Removal of damage caused by previous improper cleaning
- Removal of internal staining
- Permanent prevention of future biological growth
- A specific degree of visual improvement
- Results identical to photographs of other monuments
Some monuments require multiple treatments or visits.
Biological cleaners may continue working after the service visit, and additional improvement may occur gradually over time.
Some discoloration, staining, weathering, biological shadowing, surface deterioration, or damage may be permanent.
Payment is made for Kentucky Monument Care’s time, labor, materials, professional services, and performance of the approved scope of work—not for a guaranteed cosmetic outcome.
The Customer acknowledges that before-and-after photographs of prior projects are examples only and do not guarantee that the Customer’s monument will achieve identical results.
9. Existing and Hidden Damage
Many monuments contain existing conditions that may not be immediately visible before cleaning, including:
- Hairline cracks
- Structural fractures
- Loose sections
- Previous repairs
- Failed repairs
- Delamination
- Surface scaling
- Internal deterioration
- Hidden instability
- Weak joints
- Loose lettering
- Fragile ornamentation
- Loose attachments
- Deteriorated mortar
- Unstable foundations
- Eroded surfaces
- Crumbling stone
- Damaged finishes
- Chips
- Scratches
- Prior chemical damage
- Damage caused by previous pressure washing or abrasive cleaning
Dirt, moss, algae, lichen, biological growth, paint, debris, or staining may conceal existing deterioration.
Cleaning may reveal existing cracks, discoloration, erosion, fading, damage, repairs, or structural issues that were previously hidden.
The fact that a condition becomes visible during or after cleaning does not establish that Kentucky Monument Care caused the condition.
Kentucky Monument Care is not responsible for pre-existing conditions or damage resulting from ordinary deterioration, age, weather, previous service providers, cemetery equipment, vandalism, improper installation, structural failure, or other causes outside our control.
When practical, Kentucky Monument Care may document visible conditions before beginning work. The absence of a photograph or notation does not establish that the condition did not previously exist.
10. Fragile, Unstable, or Unsafe Monuments
Kentucky Monument Care reserves the right to refuse, postpone, limit, or discontinue service if, in our professional judgment, a monument appears:
- Unsafe
- Structurally unstable
- At risk of collapse
- Excessively fragile
- Severely deteriorated
- Improperly installed
- Loose from its foundation
- Dangerous to touch or clean
- Likely to be damaged by reasonable cleaning procedures
Kentucky Monument Care is not obligated to begin or continue work that may create an unreasonable risk of personal injury, property damage, monument collapse, further deterioration, damage to surrounding gravesites, or violation of cemetery rules.
If unsafe or previously undisclosed conditions are discovered, Kentucky Monument Care may stop work and notify the Customer.
The Customer will remain responsible for services reasonably performed before the unsafe condition was discovered.
Kentucky Monument Care does not provide structural engineering, monument-setting, or structural repair services unless specifically stated in writing.
11. Weather and Scheduling Delays
Service dates and completion dates are estimates rather than guarantees.
Outdoor monument care is dependent upon appropriate conditions. Weather, cemetery conditions, soil conditions, temperature, rainfall, freezing conditions, drought, excessive heat, equipment issues, illness, emergencies, cemetery access, funerals, burial services, seasonal restrictions, or other unforeseen circumstances may require rescheduling.
Kentucky Monument Care reserves the right to postpone service when conditions may:
- Reduce cleaning effectiveness
- Interfere with treatment performance
- Cause damage to the monument
- Create unsafe working conditions
- Violate product instructions
- Violate cemetery rules
- Prevent reasonable access
Kentucky Monument Care will make reasonable efforts to notify the Customer of material scheduling changes.
Kentucky Monument Care is not responsible for damages, losses, inconvenience, or expenses arising from reasonable scheduling delays.
12. Access to the Monument
The Customer agrees to provide Kentucky Monument Care with sufficient information and permission to reasonably access the monument.
Kentucky Monument Care is not responsible for delays or inability to complete service caused by:
- Locked gates or restricted cemetery hours
- Road closures or inaccessible cemetery roads
- Muddy or unsafe terrain
- Flooding
- Construction
- Funeral services or burial activity
- Cemetery maintenance
- Incorrect directions or inaccurate location information
- Private-property restrictions
- Animals
- Dangerous conditions
- Other circumstances outside our control
The Customer shall not require Kentucky Monument Care to trespass, enter restricted property, violate cemetery rules, or perform services under unsafe conditions.
Kentucky Monument Care may reschedule or cancel service if reasonable access is unavailable.
13. Before-and-After Photographs
Kentucky Monument Care routinely photographs monuments before, during, and after service for purposes including documentation, quality assurance, service records, condition records, customer updates, dispute resolution, training, and business operations.
Unless the Customer specifically requests otherwise in writing before service is performed, Kentucky Monument Care may also use photographs or video of the monument for:
- Website galleries
- Social media
- Marketing materials
- Educational content
- Digital advertising
- Printed advertising
- Portfolios
- Service examples
- Business presentations
Kentucky Monument Care will not intentionally publish Customer payment information, home addresses, financial information, private customer communications, or other sensitive personal information. Customer names will not be published without permission.
Because names and dates are commonly engraved on monuments and may be visible in photographs, the Customer understands that monument photographs may display publicly visible inscription information unless the Customer requests otherwise in writing before publication.
A Customer may withdraw permission for future marketing use by submitting a written request. Withdrawal will not require Kentucky Monument Care to recall, destroy, or remove materials that were lawfully produced, published, distributed, or scheduled before the request was received, except where otherwise required by law.
14. Payment Terms
Payment is due according to the Customer’s approved estimate, proposal, invoice, or payment arrangement.
The amount due shall be the price stated on the Customer’s approved estimate or invoice.
Any pricing displayed on Kentucky Monument Care’s website, advertisements, social media pages, promotional materials, or other marketing materials represents a starting price only and does not supersede the written estimate provided for the Customer’s specific project.
Kentucky Monument Care reserves the right to require:
- Full payment before service
- A partial deposit before scheduling
- A valid payment method on file
- Payment immediately after completion
- Payment according to another written payment schedule
Unless otherwise stated in writing, deposits may be applied toward scheduling, travel, administrative preparation, materials, reserved service time, or the Customer’s final balance.
Kentucky Monument Care may decline to schedule or begin service until required payment arrangements have been completed.
Accepted payment methods may include credit cards, debit cards, ACH payments, electronic payments, checks (when approved), cash (when approved), and other payment methods approved by Kentucky Monument Care.
The Customer is responsible for ensuring that all billing and payment information provided is accurate and current.
The Customer may not withhold payment solely because the monument did not achieve a particular cosmetic appearance when Kentucky Monument Care substantially performed the approved services.
Late or unpaid balances may result in:
- Suspension of services
- Cancellation of future appointments
- Collection communications
- Referral to a collection agency
- Legal action
- Other lawful collection efforts
To the extent permitted by law, the Customer agrees to pay reasonable collection costs, court costs, attorney fees, and other expenses incurred in collecting an unpaid balance.
15. Returned Payments, Chargebacks, and Payment Disputes
Returned checks, declined payments, reversed ACH payments, disputed credit card payments, or chargebacks may result in collection activity, suspension or cancellation of future services, additional fees permitted by law, reimbursement of chargeback-related costs when legally permitted, or legal action when appropriate.
Before initiating a chargeback or payment dispute, the Customer agrees to make a reasonable effort to contact Kentucky Monument Care and provide an opportunity to address the concern.
Initiating a chargeback does not eliminate the Customer’s obligation to pay for services properly authorized and performed.
Kentucky Monument Care reserves the right to provide estimates, invoices, communications, photographs, approval records, service documentation, and these Terms & Conditions to a payment processor, financial institution, collection agency, attorney, or court in response to a payment dispute.
16. Changes to the Scope of Work
The Customer may request changes to the approved scope of work before or during service. Requested changes may affect pricing, scheduling, materials, number of visits, completion time, or service availability.
Kentucky Monument Care is not required to perform additional work unless the revised scope and price are approved.
Approval may be provided through email, text message, electronic estimate approval, signed change order, recorded customer instruction, or other written or electronically documented authorization.
Kentucky Monument Care may also recommend additional services if previously undisclosed conditions are discovered.
The Customer may decline optional additional work. However, Kentucky Monument Care may discontinue the original service if the newly discovered conditions make the approved work unsafe, impractical, or materially different from the original estimate.
17. Cancellations and Rescheduling
Customers may cancel or request to reschedule service before work begins. Kentucky Monument Care may require advance notice for cancellations or rescheduling.
If Kentucky Monument Care has already purchased special materials, reserved substantial service time, traveled to the cemetery, arrived at the cemetery, begun locating the monument, begun preparing the site, or started the approved work, Kentucky Monument Care reserves the right to retain an applicable portion of the deposit or charge a reasonable amount for completed labor, travel, administrative work, materials, reserved service time, or other expenses already incurred.
Kentucky Monument Care may cancel or reschedule service due to unsafe conditions, weather, cemetery restrictions, lack of authorization, nonpayment, incorrect information, or other reasonable business or safety considerations.
If Kentucky Monument Care permanently cancels a service without performing work and without incurring Customer-specific expenses, any unearned prepaid amount will be refunded.
18. Customer Satisfaction Commitment
Customer satisfaction is important to Kentucky Monument Care.
If the Customer believes there is a legitimate issue with the quality of the work performed, the Customer agrees to notify Kentucky Monument Care within seven calendar days of service completion.
The Customer should provide:
- A description of the concern
- Relevant photographs, when available
- A reasonable opportunity for Kentucky Monument Care to inspect the concern
Kentucky Monument Care reserves the right to evaluate the concern and determine an appropriate response. When Kentucky Monument Care determines that corrective work is reasonably appropriate, we may elect to reinspect the monument, explain the expected cleaning process, allow additional treatment time, perform reasonable corrective work, or provide another appropriate resolution at our discretion.
The Customer agrees to provide Kentucky Monument Care with a reasonable opportunity to address an alleged service issue before hiring another provider or seeking reimbursement.
The satisfaction commitment does not apply to:
- Permanent staining
- Natural weathering
- Mineral deposits
- Rust or iron staining
- Existing damage
- Hidden deterioration
- Natural stone variation
- Results requiring additional paid treatments
- New biological growth occurring after service
- Cemetery or third-party damage
- Conditions outside Kentucky Monument Care’s control
- Aesthetic preferences not included in the approved scope of work
This satisfaction commitment is not a guarantee that every stain or condition can be corrected.
19. Limitation of Liability
To the maximum extent permitted by Kentucky law, Kentucky Monument Care shall not be liable for damages, claims, losses, or expenses arising from:
- Natural stone deterioration
- Existing cracks
- Hidden structural defects
- Weather-related damage
- Cemetery equipment damage occurring before or after service
- Groundskeeping activity
- Acts of God
- Vandalism
- Theft
- Third-party actions
- Delayed cemetery access
- Incorrect information supplied by the Customer
- Family authorization disputes
- Cemetery restrictions
- Natural regrowth of biological material
- Permanent staining
- Monument foundation failure
- Improper monument installation
- Previous cleaning or repair work
- Loss of sentimental value
- Loss of use
- Lost profits
- Indirect damages
- Incidental damages
- Special damages
- Consequential damages
- Punitive damages, except where such limitation is prohibited by law
Kentucky Monument Care’s maximum aggregate liability arising from a particular service shall not exceed the amount actually paid by the Customer to Kentucky Monument Care for the specific service giving rise to the claim, except where prohibited by law.
Nothing in this Agreement is intended to exclude or limit liability that cannot lawfully be excluded or limited.
The Customer acknowledges that monuments may possess substantial emotional or sentimental value that exceeds their monetary value. Kentucky Monument Care does not accept liability based upon subjective or sentimental valuation.
20. Indemnification
To the fullest extent permitted by law, the Customer agrees to defend, indemnify, and hold harmless Kentucky Monument Care and its Owners, Members, Managers, Employees, Independent contractors, Agents, Representatives, Successors, and Assigns from claims, demands, actions, liabilities, damages, judgments, settlements, penalties, expenses, and reasonable attorney fees arising from or relating to:
- Customer misrepresentation
- Lack of authorization
- Family disputes
- Ownership disputes
- Incorrect monument identification
- Inaccurate information supplied by the Customer
- Cemetery permission issues
- Customer negligence
- Customer violation of cemetery rules
- Customer instructions that conflict with third-party rights
- Claims brought by persons claiming an interest in the monument or gravesite
This section does not require the Customer to indemnify Kentucky Monument Care for liability that cannot legally be shifted to the Customer.
21. Force Majeure
Kentucky Monument Care shall not be liable for delay, interruption, or inability to perform services caused by circumstances beyond our reasonable control, including severe weather, floods, tornadoes, lightning, fire, earthquakes, natural disasters, government action, cemetery closures, road closures, civil disturbances, labor shortages, supply shortages, equipment failure, utility outages, internet or payment-processing outages, pandemics, epidemics, public-health restrictions, acts of war, terrorism, transportation disruptions, or other unforeseen events beyond our reasonable control.
Kentucky Monument Care may reschedule affected services within a reasonable period after conditions permit.
22. Ongoing Care Plans
Customers enrolled in monthly, quarterly, semiannual, annual, or other recurring monument care plans may be subject to additional plan-specific terms.
Those terms may address visit frequency, included services, automatic payments, recurring billing, renewal, cancellation, price changes, missed or postponed visits, weather delays, plan exclusions, customer responsibilities, and service-area limitations.
If Kentucky Monument Care provides a separate Monument Care Plan Agreement, subscription agreement, recurring-payment authorization, or plan description, that document is incorporated into this Agreement.
If a direct conflict exists between these Terms & Conditions and a signed or electronically accepted Monument Care Plan Agreement, the plan-specific agreement will govern the conflicting issue.
23. Recurring Billing Authorization
When the Customer enrolls in a recurring care plan and provides a payment method, the Customer authorizes Kentucky Monument Care and its payment processor to charge the agreed recurring fees according to the selected plan.
Recurring charges may continue until the plan is canceled according to the applicable cancellation terms.
The Customer is responsible for maintaining a valid payment method, updating expired payment information, reviewing invoices and receipts, and providing timely notice of billing concerns.
A failed recurring payment may result in suspension or cancellation of future services.
Kentucky Monument Care will provide any notices regarding automatic renewal, cancellation, or price changes required by applicable law.
24. Communications
By requesting service, submitting a quote request, accepting an estimate, enrolling in a Monument Care Plan, providing your telephone number or email address, or otherwise initiating business with Kentucky Monument Care, you consent to receive communications from Kentucky Monument Care through:
- Telephone calls
- SMS (text messages)
- Voicemail
- Customer portals
- Other electronic communication methods reasonably necessary to provide our services
These communications may include, but are not limited to:
- Quote confirmations
- Estimate notifications
- Appointment scheduling
- Appointment reminders
- Route updates
- Service confirmations
- Before-and-after photo notifications
- Invoice notifications
- Payment confirmations
- Customer support
- Monument Care Plan reminders
- Account notifications
- Review requests
- Service follow-up communications
- Promotional offers and marketing communications (only where the Customer has separately consented)
Kentucky Monument Care may send both transactional (non-marketing) and marketing text messages.
Transactional text messages include communications necessary to provide requested services.
Marketing messages will only be sent to Customers who have separately opted in to receive promotional communications where required by law.

Customers may opt out of marketing text messages at any time by replying STOP to any marketing text message.
Customers may request assistance by replying HELP to any text message or by contacting Kentucky Monument Care directly.
Customers who opt out may re-enroll in SMS communications by submitting a new opt-in form or by otherwise providing renewed written consent.
Opting out of marketing messages will not prevent Kentucky Monument Care from sending legally permitted transactional communications necessary to complete requested services, including appointment reminders, invoices, payment confirmations, scheduling updates, or customer support communications.
Wireless carriers are not liable for delayed or undelivered messages.
25. SMS Messaging Terms
By providing your mobile telephone number and affirmatively opting in where required, you agree to receive SMS text messages from Kentucky Monument Care.

- Estimate notifications
- Invoice notifications
- Payment confirmations
- Before-and-after photo notifications
- Customer support responses
- Monument Care Plan reminders

Customer information may be collected and used for legitimate business purposes, including:

- Maintaining service records
- Customer support
- Monument Care Plan administration
- Business operations
- Fraud prevention
- Legal compliance
Kentucky Monument Care may share information with trusted service providers who assist with:
- Payment processing
- Customer relationship management
- Scheduling
- Email delivery
- SMS delivery
- Accounting
- Website hosting
- Data storage
- Legal or professional services
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Information sharing with subcontractors performing support services (such as customer service, payment processing, CRM management, scheduling, or messaging delivery) is permitted solely for the purpose of operating Kentucky Monument Care's business.
Text messaging originator opt-in data and customer consent will never be sold or shared with third parties or affiliates for marketing or promotional purposes.
Kentucky Monument Care may disclose information when required by law or when reasonably necessary to:
- Comply with legal obligations
- Respond to lawful requests
- Protect our legal rights
- Prevent fraud
- Collect unpaid balances
- Protect customer or public safety

27. Independent Contractor Status
Kentucky Monument Care is an independent service provider.
Nothing in this Agreement creates an employment relationship, a partnership, a joint venture, an agency relationship, or a fiduciary relationship between Kentucky Monument Care and the Customer.
Kentucky Monument Care retains control over the manner and means by which approved services are performed, subject to the agreed scope of work and applicable cemetery requirements.
28. No Waiver
Kentucky Monument Care’s failure to enforce any provision of this Agreement on one occasion does not waive our right to enforce that provision or any other provision in the future.
Any waiver must be in writing and authorized by Kentucky Monument Care.
29. Governing Law and Venue
This Agreement shall be governed by and interpreted according to the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles.
Any legal action arising from or relating to this Agreement or the services provided shall be brought in a court of competent jurisdiction located in Kentucky, unless applicable law requires otherwise.
The parties agree to make a reasonable good-faith effort to resolve disputes informally before filing legal action.
30. Severability
If any provision of this Agreement is found to be invalid, unlawful, or unenforceable, that provision shall be modified or limited to the minimum extent necessary to make it enforceable when legally permitted.
If modification is not permitted, the affected provision shall be severed. The remaining provisions shall remain in full force and effect.
31. Assignment
The Customer may not assign or transfer their rights or obligations under this Agreement without Kentucky Monument Care’s prior written consent.
Kentucky Monument Care may assign this Agreement in connection with a business sale, reorganization, merger, transfer of business assets, use of subcontractors, or another lawful business purpose, provided that the assignment does not materially reduce the Customer’s rights.
32. Electronic Records and Signatures
The Customer agrees that electronic communications, electronic approvals, electronic signatures, checkbox acceptances, payment confirmations, text-message approvals, and digital records may be used to establish acceptance of an estimate, acceptance of these Terms & Conditions, authorization to perform work, approval of pricing, approval of scope changes, payment authorization, or other agreements between the parties.
Electronic records and signatures shall have the same effect as paper records and handwritten signatures to the extent permitted by law.
33. Updates to These Terms
Kentucky Monument Care may update these Terms & Conditions from time to time.
The version applicable to a particular one-time service will generally be the version presented, linked, or made available when the Customer approves the estimate or authorizes the service.
For ongoing care plans, revised terms may become applicable after Kentucky Monument Care provides any notice required by law or by the applicable plan agreement.
Changes will not retroactively alter completed transactions unless agreed to by the parties or required by law.
34. Entire Agreement
These Terms & Conditions, together with any applicable approved estimate, invoice, proposal, change order, Care Plan Agreement, recurring-payment authorization, written service description, or written amendment constitute the complete agreement between Kentucky Monument Care and the Customer regarding the applicable services.
No oral promise, statement, representation, advertisement, social media post, website price, or prior discussion modifies the Agreement unless it is included in a written or electronically documented agreement approved by Kentucky Monument Care.
In the event of a direct conflict, a more specific written agreement concerning the Customer’s particular project will control over a more general provision of these Terms, unless the specific agreement states otherwise.
35. Acceptance of Terms
By approving an estimate, accepting an invoice, making payment, electronically checking an agreement box, electronically signing a proposal, scheduling service, requesting that work proceed, or permitting Kentucky Monument Care to begin work, the Customer acknowledges and agrees that:
- The Customer has read these Terms & Conditions;
- The Customer understands these Terms & Conditions;
- The Customer has authority to authorize the requested services;
- The Customer accepts the approved scope of work;
- The Customer accepts the quoted pricing;
- The Customer understands that website and advertised prices are starting prices only;
- The Customer understands that every project is individually quoted; and
- The Customer agrees to be bound by these Terms & Conditions.
